This Privacy Notice (updated periodically) seeks to clarify how the Company collects, utilises, and shares personal data.

1.2. When using our website to fulfil various needs (primarily to engage with our services), you may be required to provide us with various types of personal information. We collect data about you and/or about your use of our website and/or when receiving the services offered on the site.

1.3. Please ensure you have carefully read and understood this Privacy Notice before using the Website or providing personal information via the Website. If you disagree, in whole or in part, with the terms of this Privacy Notice, please refrain from providing any personal data to the Company through the Website or within the Website services.

1.4. While this Privacy Notice is drafted in masculine language for convenience, it applies equally to all genders.

2. Definitions

2.1. "Law" refers to the Data Protection Act 2018 (as amended) and the UK GDPR.

2.2. "You" or "User", "Site", "Services", "Clinician", "Patient", "Product" are as defined in our terms of use, accessible at healthy-mind.co.uk/terms-and-conditions/

 

3. Legal basis

3.1 Where you have paid us to provide the service to you, in accordance with our terms of use, we process your data under our contractual obligations to provide the service.  Where we may use your data for the development of our platform to provide better services to you and to enhance the platform, we process your data under our legitimate interests to improve the platform.

3.2. Any personal data you provide to the company as a user of the platform is given willingly, and you are aware that there is no legal obligation to do so. However, you understand that failing to provide this personal data, in whole or in part, may prevent you from fully utilising the Company's services.

3.3. The personal data you provide will be stored in the company's database. The Company may use it for the purposes outlined in this privacy notice, either directly or through third parties acting on its behalf (including potentially transferring it to third parties acting on our behalf, located outside the UK), in accordance with the provisions of this Privacy notice.

3.4. You assert that the personal information you provide to the Company is comprehensive, accurate, and up-to-date.

As part of using the platform and/or engaging with the Company, you may be asked to provide the Company with personal data. The Company may also collect personal data about you through various technological means, as detailed in Section 8 below.

4.1. Personal Data You Provide to the Company

4.1.1. To contact us through the site (for any purpose), you will need to provide personal data which includes contact information (First name and last name, telephone, email address);

4.1.2. To avail of our services, you may be asked to provide the Company with additional personal data either through the platform or otherwise. Such personal data could include your medical and health-related data (such as medical and therapeutic history, medicines you are taking or have taken, your mental state, membership of health organisations), demographic information, credit card information for payment purposes, etc.

4.2. Collection of Personal Data by the Company

4.2.1 The Company may employ various technological instruments for the collection of your personal data. The types of instruments may depend on how you interact with the Company, such as via computer, mobile device, or telephone, and the type of services the Company provides to you. Subject to the aforementioned, the Company may collect the IP address of the device you utilise to access the site. Your interactions with the Company's customer service hotline may also be recorded.

 

5. Company's Use of Personal Information

The Company collects and processes your personal data for the following purposes (these may be updated occasionally):

(a) To provide Services when you engage with us. The personal data you supply within the Services (for instance by filling out medical assessment questionnaires) is used for initial assessment and shared with your assigned Psychiatrist. This enables them to offer medical advice on the recommended treatment for you, and to coordinate follow-up appointments with mental health practitioners, if required;

(b) To deliver customer service, which includes providing service and administrative messages, receiving feedback on the use of the site and services, monitoring service provision, and improving the site, service, and product. The Company may reach out if you experience difficulties using the Services;

(d) To process your payment for the Services you purchase from the Company;

(e) To share information with third parties (e.g., doctors, cloud computing providers, subcontractors, payment processors, consultants, service providers) who work on behalf of the Company to maintain the site and provide the Services;

(f) To share information during various Company procedures (e.g., mergers, reorganisations, dissolution, etc.);

(g) To share with legal authorities and/or in response to a court order and/or as required by law;

(h) For enforcing the Terms of Use, this Privacy Notice, and for compliance with the privacy laws applicable to the Company.

 

6. Disclosure of Information to Third Parties

6.1. Some of the Services are carried out by third parties, acting as subcontractors on behalf of the Company. Hence, the use of the Website and/or the Services may result in the disclosure of certain information to the relevant service providers, in line with the purposes of data use stated in this Policy. In general:

6.1.1. The Company may share personal data with cloud computing providers (which may be based outside of the UK) for storage and/or data backup purposes.

6.1.2. The Company may grant access to information systems containing personal data to software providers for maintenance and repair purposes. The Company may also share or grant access to personal data to various service providers assisting the Company under this Privacy Notice, including consultants and companies providing messaging services.

6.1.3. As part of the Services, the Company will share your personal data with physicians, enabling them to provide the medical care and advice you seek.

6.1.4. The Company may share personal data in response to competent authorities and/or court orders and/or as necessary to protect the Company's rights and assets.

6.1.5. The Company may share personal information during mergers, reorganisations, asset sales, liquidations, business acquisitions, or similar operations.

6.1.6. Without detracting from the above, the Company may share anonymised data, as detailed in Section 8.4 below, without limitation.

6.2. Transferring Information Abroad: Your information may be transferred to third parties located outside of the UK, including to countries with lesser privacy protection than the UK, for the aforementioned purposes. We will ensure the third country is considered adequate by the UK, or will implement appropriate safeguards to protect your data

 

7. Provision of Personal Data to Physicians by Yourself

7.1. You acknowledge that during the provision of services from your assigned Psychiatrist, you may be obliged to directly provide additional personal data, beyond the data already submitted to the company. For clarity, the company is not a party to your medical or therapeutic process with your Psychiatrist, and any data you directly provide to them is solely in the context of your relationship with them. The company does not have knowledge of the personal data required by your assigned Psychiatrist nor the use of such data. Any claims or requests you might have concerning the provision of personal data to your assigned Psychiatrist during treatment and/or medical advice must be addressed to your assigned Psychiatrist directly.

 

9. Collection of Data

9.1. The Company collects anonymised data sent by your computer, mobile phone, or other access devices during your use of the website, including when receiving Services. This data is anonymised – it does not personally identify you and cannot be associated with you.

9.2. The anonymous data collected may include, among other things: data on accessed pages, device type, computer and connection information, mobile device network information, page view statistics, site traffic data, referral URL, etc.

9.3. The Company analyses and utilises such anonymised data, either directly or through third parties, for the purposes outlined in Section 5 above, as well as: (a) to assess how users interact with the website and/or services for site management, enhancement, and promotion; (b) troubleshooting; (c) enhancing user experience on the site; (d) statistical analysis, research and segmentation of site usage patterns; and (e) any other legal purposes deemed appropriate by the Company.

9.4. The Company may disclose anonymised data to third parties working on its behalf to achieve the objectives mentioned above and for any other legal purposes it sees fit.

11.1. The Company uses well-established information security technologies on the site and will make reasonable efforts to ensure the website and its services are free from viruses, worms, or Trojans. However, personal data required by the Company for a legitimate purpose such as defence against claims will be maintained by the Company for the duration mandated by law.

13. Miscellaneous

13.1. Company Policy Regarding Minors: The website and services are designed for adults (those aged 18 and over) and are not intended for minors. We do not intentionally provide the website or services for those aged under 18.
